The Employee Retirement Income Security Act of 1974 is a federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry. ERISA compliance for welfare plans is focused on protecting participants and beneficiaries. This is accomplished by requiring access to plan information and imposing fiduciary responsibilities on those who manage and control plan assets as well as exercise discretion over the management of the plan. Employers need an understanding of the basic rules related to sponsoring a welfare plan.

Biography - Manuel Mendoza, J.D.

Based in our Portland office, Manuel serves as the In-House ERISA Counsel for USI’s Northwest region, advising the employee benefits practice group. Manuel has over 10 years experience, primarily focusing on employment benefit legislation, compliance, and the corresponding legal challenges. Manuel provides guidance regarding compliance and legal issues related to group health and welfare benefit plans for both private and public sector employers.

As a compliance professional, Manuel possesses extensive experience addressing federal, state and local laws related to employee benefits and healthcare. He regularly interacts with regulatory agencies such as the DOL, IRS, CMS, HHS, and state insurance departments.

Manuel is actively involved in identifying and implementing cost-effective solutions that are in compliance with health care reform mandates. Manuel is a regular speaker at national and state conferences sponsored by private and public employers and a contributor to employee benefit publications.

Prior to joining USI, Manuel served at the United States Department of Labor (DOL) Employee Benefits Security Administration. While employed at the DOL, Manuel helped employers comply with various federal laws governing health and welfare plans, conducted criminal investigations, and supported civil enforcement litigation and criminal prosecutions. As a former DOL Investigator, Manuel brings a unique perspective to CEOs, CFOs and Risk Managers.

Manuel holds a J.D. from Chapman University, Dale E. Fowler School of Law and is a licensed attorney in the state of California.
